OFFICIAL CONTEST RULES

 

Void outside the 50 United States and where prohibited. Do not enter this contest if you are not at least 21 years of age and a legal resident of, and located within, one of the 50 United States (excluding Puerto Rico) at the time of entry.

 

NO PURCHASE NECESSARY TO ENTER OR WIN. 

 

The Laughing Baby Video Contest begins November 1, 2008, and ends December 16, 2008.  Entries must be received by 11:59 p.m., C.T., on December 16, 2008. Sponsor:  Meredith Corporation.

 

ELIGIBILITY: Legal residents of the 50 United States, and the District of Columbia, 21 years of age or older, who are the parent or legal guardian of a baby (from newborn to 6 years old), and who are registered users of http://www.youtube.com are eligible to enter, except employees of Sponsor, and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the contest and/or their respective agents, affiliates, subsidiaries, and members of their immediate families or persons residing at the same address.  To become a registered user of http://youtube.com, you must register for an account (“YouTube Account”) and agree to the site’s “Terms of Use” set forth at http://www.youtube.com/t/terms (“Terms of Use”). There is no fee or charge to become a registered user.

 

ENTRY:  Go to www.youtube.com/parentstvbabyhaha and upload a video ten (10) seconds to three (3) minutes in length of a laughing baby from newborn to 6 years old of whom you are parent or legal guardian. Entry materials (video) must be original (created by the entrant), unpublished and may not have previously won any award or prize.  Entrants may enter multiple videos, as long as each video is unique and complies with all other terms hereof.  DO NOT include music in the video submission unless you can provide documentation that you have obtained all necessary rights and clearances required to use the music from the performer, musicians, music publisher, writer and any other party with an interest in the materials used  No group entries. 

 

Sponsor may contact (through YouTube’s electronic communication system)current YouTube users whose videos on the YouTube site have subject matter that suggests to Sponsor, in its sole discretion, that such users may be interested in entering the Contest, making such users aware of the Contest and the opportunity to enter.  Neither the selection of YouTube users to contact, nor any communication to such users, will be done by any individual involved in judging Contest entries.  Contest judges will not be given any information that would distinguish videos submitted by contacted YouTube users from those submitted by any other entrant. 

 

By submitting a video for the Contest: (1) Entrant represents and warrants to Sponsor that he/she has obtained all necessary licenses, consents, waivers, releases, authorizations and/or permissions to post or transmit the entry video; (2) Entrant represents and warrants that the video does not constitute or contain any confidential information and is free of any claims of proprietary or personal rights; (3) Entrant is solely responsible for the video that he/she submits for the Contest; (4) Entrant agrees that such video is original and created by Entrant and that Entrant owns all right, title and interest in the video and any elements Entrant includes in the video, such as photographs, video footage, music tracks and the like (Entrant understands that Entrant may be required to provide documentation in a form acceptable to Sponsor evidencing such rights); and (5) Entrant grants to Sponsor and its affiliated entities an irrevocable, worldwide, nonexclusive, perpetual, fully sub-licensable, transferable, royalty-free right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, transmit, publicly perform, and publicly display such video (in whole or part) without compensation, notification, approval or any other obligation, to anyone, including Entrant.

 

Sponsor reserves the right, in its sole discretion, to reject, disqualify, modify, edit, and revise any videos or related materials that are nude, obscene, defamatory, profane, offensive, lewd, pornographic, false, misleading, deceptive, or otherwise inconsistent with its editorial standards, audience expectations, or reputational interests or that Sponsor believes may violate any applicable law or regulation or the rights of any third party.  Sponsor reserves the right, in its sole discretion, to verify any element of any entry or related materials and to disqualify any entrant whose participation may subject the contest, Sponsor, or Sponsor's advertisers, clients, or customers to controversy, negative publicity, scorn, or ridicule.  

 

Sponsor further reserves the right to disqualify and remove any entry that infringes or violates any party's intellectual property rights, including, but not limited to, using third-party copyrighted materials or the names or likenesses of others without appropriate permission and attribution, using third-party trademarks without appropriate permission or attribution, and using or distributing third-party information (whether or not protected as a trade secret) in violation of a duty of confidentiality;

 

JUDGING:  First Round - On or about December 17, 2008, a qualified panel of judges will judge eligible entries on the basis of the on-camera personality of the child (40%), the cuteness of the laugh (40%), and the overall quality of the video (20%).  Twenty (20) Finalists will be determined. Sponsor reserves the right to select fewer than twenty (20) finalists if, in its sole discretion, fewer than twenty (20) eligible entries meet the criteria for finalist selection. In the event of a tie, the winning entry will be the entry among the tied entries with the higher/highest score in the criterion of on-camera personality.  Potential Finalists will be notified by message to their YouTube Account. Decisions of judges are final and binding in all respects. 

 

            Second Round- Each Finalist video will be available for viewing at www.parents.com between December 18, 2008 and January 30, 2009, and the public will be invited to vote for their favorite finalist photo. One vote per e-mail address, per video, per day. The entrant whose video receives the most public votes in the second round will be the winner. In the event of a tie in the second round, the entrant who received the highest score in the overall on-camera personality category in the first round will be the winner. Potential winner will be notified by phone and/or e-mail and the prize delivered on or about February 27, 2009.

 

PRIZING:  One (1) winner will receive a Sony camcorder (ARV $800) and a $200 VISA check card (ARV $200). Total ARV $1000.00.  Check card subject to issuer restrictions.

 

Sponsor reserves the right to substitute prizes (or portions thereof) of equal or greater value if prizes (or portions thereof) cannot be awarded as described. Sponsor will determine all elements of prizing in its sole discretion. Prizes may not be assigned, transferred, changed or redeemed for cash, except at the sole discretion of Sponsor.   Prizes are awarded “as is” with no warranty or guarantee express or implied. Sponsor disclaims all and any liability for the actual provision, quality or nature of any third party product or service accepted by the winners. The awarding of any prize is contingent upon full compliance with these Official Rules.  Entrants agree to be bound by Official Rules and agree that if any winner fails to provide proof of identity, refuses to provide required affidavit, is found to have violated the Official Rules or otherwise does not meet eligibility criteria, prize will be forfeited and awarded to an alternate winner with the next highest score. Entrants understand that Sponsor is not liable for injuries, losses or damages of any kind arising from participation in this promotion and acceptance, possession and use of prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prize. Decisions of Sponsor are final and binding in all respects. 

 

PRIVACY:  Information collected from online entrants is subject to Sponsor’s privacy policy at www.parents.com and www.youtube.com’s Terms of Use.

 

DISPUTE RESOLUTION:  Except where prohibited, by participating Contest entrants agree that:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant(s) and Sponsor and its agents shall be governed by and construed exclusively in accordance with the laws of the State of New York without giving effect to any principles of conflicts of law of any jurisdiction. Entrant agrees that any action at law or in equity arising out of or relating to this Contest, or awarding of the prizes, shall be filed only in the state or federal courts located in the State of New York and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this Contest, entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or awarding of the prizes, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Contest but in no event attorneys' fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.

 

OTHER:  Sponsor assumes no responsibility for entries it is unable to process due to network, hardware or other technical failures; or any other reason, or incomplete, damaged, misdirected, or lost entries.  Sponsor reserves the right, in its sole discretion to disqualify any person tampering with the entry process, the operation of the web site or otherwise in violation of the rules. Sponsor further reserves the right, in its sole discretion, to cancel, terminate or modify this promotion if not capable of completion as planned, including infection by computer virus, technical corruption, non-authorized human intervention or force majeure.  In the event of cancellation, Sponsor reserves the right to select winners from among all eligible entries received prior to date of cancellation.  The use of automated entry systems or any other conduct that impedes the integrity of the contest is prohibited.  In the event of a dispute regarding online entry, entry will be deemed made by the holder of an established e-mail account associated with the entry.

 

RELEASES:  By entering this contest, you authorize the Sponsor to use your video, your  and your child’s name, voice, likeness, biographical data, city and state of residence and entry materials in promotional material and for advertising, public relations and editorial purposes worldwide, in perpetuity, or on a winner’s list, if applicable, without further compensation unless prohibited by law.  Sponsor is not obligated to use any of the above-mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation. 

 

Except where prohibited by law, potential winner will be required to complete and return an Affidavit of Eligibility/Ownership/Liability Release, Publicity Release and Copyright Assignment within three (3) days of notification or the entry with the next highest score may become an alternate winner. If winner notification is returned as undeliverable, the entry with the next highest score may become an alternate winner.  By participating and winning a prize, winners release Sponsor, and its parents, affiliates, subsidiaries and agencies and their respective directors, officers, employees and agents from any and all liability with respect to the prize won and participation in the contest  Subject to all U. S. federal, state and local laws and regulations.  Void where prohibited.  Taxes on prizes are sole responsibility of winner. Winner will be issued a 1099 tax form in the amount of the actual prize value. VT residents may omit return postage.
