CONTEST PERIOD: The Our Favorite Pediatricians Contest ("Contest") begins at 12:01 a.m. Eastern Time ("E.T.") on March 3, 2014 and ends at 11:59 p.m. E.T. on May 31, 2014 ("Contest Period").
SPONSOR: Meredith Corporation, 1716 Locust St., Des Moines, Iowa ("Sponsor").
ENTRY: During the Contest Period, visit www.parents.com/favorite-doctors and follow the instructions provided to complete the online entry form, including the full name of the pediatrician, city and state of practice, contact phone number, and a description (in 250 words or less) of your pediatrician conveying details such as, how he/she goes the extra mile for his/her patients, how he/she improves the community, and/or how he/she is doing something noteworthy in his/her field (collectively, an "Entry"). The eligible pediatrician nominated in the Entry will be referred to as the "Nominee" hereinafter.
Entry must (i) be entrant's own original work, (ii) be in English, (iii) cannot be previously published or submitted in connection with any other contest, (iv) be in keeping with the Sponsor's image and (v) not be offensive or inappropriate, as determined by the Sponsor in its sole discretion, nor can it defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or property rights or any other third party rights. Sponsor reserves the right to disqualify any Entry that it determines, in its sole discretion, is offensive or inappropriate, not in keeping with Sponsor's image or that is otherwise not in compliance with these Official Rules.
By submitting an Entry, entrant acknowledges and agrees that Sponsor may obtain many Entries in connection with this Contest and/or other contests staged and/or promoted by the Sponsor, and that such Entries may be similar or identical in theme, idea, format or other respects to other Entries submitted in connection with this Contest and/or other contests sponsored by the Sponsor or submitted for other reasons or other materials developed by the Sponsor. Entrant waives any and all claims entrant may have had, may have, and/or may have in the future, that any Entry and/or other works accepted, reviewed and/or used by the entrant may be similar to his/her Entry, or that any compensation is due to entrant in connection with such Entry or other works used by Sponsor.
Sponsor reserves the right, in its sole discretion, to reject and/or disqualify any Entries, subjects, or related materials that Sponsor deems to be obscene, defamatory, profane, offensive, lewd, pornographic, false, misleading, deceptive, or otherwise inconsistent with its editorial standards, audience expectations, or reputational interests, or that Sponsor believes may violate any applicable law or regulation or the rights of any third party. Sponsor reserves the right, in its sole discretion, to disqualify any Entry which may subject the Contest, Sponsor, or Sponsor's advertisers, clients, or customers to controversy, negative publicity, scorn, or ridicule.
All Entries must be received by 11:59 p.m. ET on May 31, 2014 to be eligible. Entries generated by script, macro or other automated means or by any means which subvert the entry process will be void. All Entries become the property of the Sponsor and will not be acknowledged or returned. Sponsor reserves the right, in its sole discretion, to: (i) verify any element of any entry, related materials or entrant's eligibility; (ii) to request additional information; and (iii) to disqualify any entrant whose participation may subject the Contest, Sponsor or Sponsor's advertisers, clients, or customers to controversy, negative publicity, scorn, or ridicule. By entering this Contest, you agree to provide any documentation or information deemed necessary by, and in a form acceptable to, Sponsor to satisfy the above requirement if asked by Sponsor to do so.
LIMIT: One (1) Entry per person and per email address throughout the Contest Period. Entries received from any person or email address in excess of the stated limitation will be void. You may only use one (1) email address to enter this Contest.
ENTRANT ELIGIBILITY: This Contest is open to legal residents of the 50 United States and the District of Columbia, 21 years of age or older. Employees of Sponsor, Johnson & Johnson Consumer Companies, Inc. the makers of DESITIN® ("DESITIN®") and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Contest and each of their respective parents, agents, affiliates, subsidiaries, and advertising and promotion agencies, and their immediate family members (regardless of where they reside) or household members, whether or not related, are not eligible to enter or win. "Immediate family members" shall mean spouses, parents, step-parents, children, step-children, siblings, step-siblings, and their respective spouses. "Household members" shall mean people who share the same residence at least three months per year.
PEDIATRICIAN ELIGIBILITY: A nominated pediatrician must be a legal resident of the 50 United States and the District of Columbia, 21 years of age or older, who is a member of the American Academy of Pediatrics and who is not affiliated with Parents as a member of the Parents Board of Advisors. Pediatricians who were winners in the Parents and DESITIN® "2013 Doctors Making a Difference" promotion are not eligible to win.
JUDGING: On or about June 3, 2014, a qualified panel of judges from Parents' Editorial Staff will judge all eligible Entries received throughout the Contest Period based on the following criteria: pediatrician's willingness to go the extra mile for his/her patients (50%) and how pediatrician improves the community, and pediatrician's noteworthy work in his/her field (i.e., research, charity work, etc.) (50%). The seven (7) Entries with the highest total scores will be deemed potential Winning Entries. The entrants who submit the potential Winning Entries will be deemed the potential Winners and the Nominees associated with the Winning Entries will be deemed the potential Winning Pediatricians. In the event of a tie, an additional, tie-breaking judge will judge the tied Entries using the judging criteria above to determine the potential Winning Entry. Sponsor reserves the right to choose fewer than seven (7) Winning Entries if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries. Prize awards are subject to verification of eligibility and compliance with these Official Rules.
WINNER NOTIFICATION: Potential Winners and potential Winning Pediatricians will be notified via email, telephone and/or mail and will be required to complete and return an Affidavit of Eligibility and Release of Liability/Publicity within ten (10) days of date of notification or a runner-up potential Winner and potential Winning Pediatricians may be notified. If such documents are not returned within the specified time period, a potential Winner and/or potential Winning Pediatrician notification is returned as undeliverable, Sponsor is unable to contact a potential Winner and/or a potential Winning Pediatrician, or a potential Winner and/or potential Winning Pediatrician is not in compliance with these Official Rules, an alternate potential Winner and potential Winning Pediatrician may be notified, in Sponsor's sole discretion. Potential Winners' and potential Winning Pediatricians' names and likenesses may be used in editorial, advertising and/or other marketing materials in association with DESITIN®. As a condition of accepting a prize, each potential Winner and potential Winning Pediatrician will be required to consent to the use of his/her name and likeness in association with DESITIN® as detailed herein.
PRIZES (14): Winning Pediatrician Prizes (7): A $1,000 donation to the child-focused, 501(c)(3) charitable organization of Winning Pediatrician's choice ("Charitable Organization") and the opportunity for Winning Pediatrician to be featured in a future issue of Parents Magazine; Approximate Retail Value ("ARV"): $1,000 each. Winner Prizes (7): A $500 gift card to Walmart; ARV: $500 each. Total ARV of all prizes: $10,500.
PRIZE CONDITIONS: Prizes are awarded "as is" with no warranty or guarantee, either express or implied by Sponsor. Winners and Winning Pediatricians may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. Winners, Winning Pediatricians and Charitable Organizations are responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. Walmart gift cards are subject to certain terms and conditions as specified by issuer. The awarding of any prize is contingent upon each Winning Pediatrician's, Charitable Organization's and Winner's full compliance with these Official Rules. All prize details are at Sponsor's sole discretion.
WINNING PEDIATRICIANS: As a condition of receiving a prize, each Winning Pediatrician will be required to participate in an interview and/or photo shoot and provide photos to Sponsor for feature in a future issue of Parents and/or other editorial, promotional or marketing materials for Sponsor and DESITIN®. Interviews and/or photo shoots on dates specified by Sponsor, in its sole discretion, or prize will be forfeited and Sponsor will have no further obligation to such Winning Pediatrician. Failure to participate in an interview and/or photo shoot or provide photos to Sponsor for use as specified above will result in disqualification. The opportunity to be featured in a future issue of Parents has no retail value, and in the event that such portion of the prize cannot be awarded, no compensation or substitution will be provided in lieu thereof.
CHARITABLE ORGANIZATIONS: The Charitable Organization that a Winning Pediatrician selects to receive the $1,000 donation must qualify for federal income tax exemption under Section 501(c)(3) of the Internal Revenue Code and is subject to approval by Sponsor, in its sole discretion. An authorized representative of each Charitable Organization will be required to complete a Release of Liability/Publicity (unless prohibited by law) and any other documents required by Sponsor on behalf of such Charitable Organization to accept the donation. As a condition to and by acceptance of a donation in connection with this Contest, Charitable Organization will be required to confirm in writing that (a) Released Parties (as defined below) are released, will have no liability whatsoever for, and shall be held harmless by such Charitable Organization against any liability for any injuries, losses or damages of any kind to person(s), including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize; (b) except where legally prohibited, Charitable Organization grants permission to Sponsor and those acting under its authority the right to the use of the name, logos and trademarks of Charitable Organization and/or its picture, likeness, and information, at any time or times, for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide in perpetuity, and on the Internet and World Wide Web, without notice, review or approval; (c) use of any funds awarded by Sponsor shall be subject to Sponsor's reasonable review and approval. Donation will be made directly from Sponsor to Charitable Donation and will not be tax deductible for the Winning Pediatrician or any other third party.
ARBITRATION: Except where prohibited by law, as a condition of participating in this Contest and/or accepting a prize, entrants, Winners, Winning Pediatricians and Charitable Organizations agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at a AAA regional office in New York, NY; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrants, Winners, Winning Pediatricians and/or Charitable Organizations be permitted to obtain awards for, and entrants, Winners, Winning Pediatricians and Charitable Organizations hereby waive all rights to claim punitive, incidental or consequential damages including attorney's fees or any other damages, other than for entrant's, Winner's, Winning Pediatrician's, Charitable Organizations actual out-of-pocket expenses (i.e., costs associated with participating in this Contest), and entrants, Winners, and Winning Pediatricians further waives all rights to have damages multiplied or increased.
RELEASES: By participating in this Contest and/or accepting a prize, entrants, Winners, Winning Pediatricians and Charitable Organizations agree to release Sponsor, DESITIN? and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Contest and each of their respective parents, agents, affiliates, subsidiaries, advertising and promotion agencies, and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, in whole or in part, directly or indirectly, from participation in this Contest, the acceptance, use or misuse of any prize (or portion thereof) and/or the use of his/her name, hometown (city and state), voice, biographical information, likeness, photograph and any statements regarding this Contest in all media now known or hereafter discovered, for any purpose, including without limitation, in connection with, and to promote, market or advertise, the Contest or DESITIN®, in whole or in part, without review, approval, credit or attribution, notification or payment from or to such entrant, Winner, Winning Pediatrician, Charitable Organization or any person or entity, worldwide and in perpetuity.
OTHER: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, undelivered, garbled or misdirected Entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of Entries, the announcement of the Winners, Winning Pediatricians or Charitable Organizations, or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to entrant's or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website. Sponsor reserves the right, in its sole discretion to disqualify any person tampering with the Entry process, the operation of the web site or otherwise in violation of these Official Rules. Sponsor further reserves the right, in its sole discretion, to cancel, terminate or modify this Contest if the Contest is compromised by virus, technical corruption, non-authorized human intervention, or any other causes which, in the sole discretion of the Sponsor, corrupt or affect the administration, security, fairness, proper play or integrity of the Contest. In the event of cancellation or termination, Sponsor reserves the right to determine the potential Winning Entry from among all eligible, non-suspect Entries received prior to date of cancellation or termination using the judging process detailed herein. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
Except where prohibited by law, participating in this Contest as an entrant, Winner, Winning Pediatrician and Charitable Organization constitutes permission to use each entrant's, Winner's, Winning Pediatrician's and Charitable Organization's name, hometown (city and state), voice, biographical information, likeness, photograph and any statements regarding this Contest in all media now known or hereafter discovered, for any purpose, including without limitation, in connection with, and to promote, market or advertise, the Contest, in whole or in part, without review, approval, credit or attribution, notification or payment from or to entrant, Winner, Winning Pediatrician, Charitable Organization or any person or entity, worldwide, in perpetuity, or on a winners' list, if applicable. Contest is subject to all applicable U. S. federal, state and local laws and regulations.
